Don't think it works like that mate, if it ends up 70/30, they pay 30% and your insurer pays 70%.
So if the claim was for £1000, they pay £300, your insurer pays £700 - so you would only get money back if the 70% is less than your £350 excess.
huh oright, i though that i paid 350 excess, if it was 100% other party, then i would get this whole amount back, if it was 50/50 i was get half and continued like that?
thats what happened to my bro who won 50/50 with his golf and got 50% of the excess back
one other thing i cant understand is that, I was 21, at the time according to my insurance I had a young driver excess of £450, and then voluntary excess of £150, totaling 600 quid, but there only took £350 i never questioned it just in case lol
Hmmm, I've never heard anything like that before, but never been in that position so haven't any experience of how it works.
You're right that if it's 100% other party's fault then you get all your excess back as the other insurer picks up all costs, but can't see how it would get split up unless insurance companies have become a little fairer :tongue_smilie:
Sounds like they just took the wrong excess off you that time, good idea not to say anything!

Slight update on this, third party are proceeding to court, and my insurers have appointed solicitors.
just spoke to them and they asked whether im willing to go to court and defend 100% not my fault, lol i laughed and said have you not read what happened? and i would be daft to try do that, cause 70% was my fault. and she said they cant go to court and try to win split liaibility its got to be 100% etheir way, and i asked why not? then she started to change her tone saying that we could go to court and try.
She said if you win liaibity or loose and its put 100% on me, then it wont make a difference to my insurance premium, which ive said to them from the start im not bothered about that, its the principle that the other driver thinks she was a perfect driver on the day and she did not make one mistake, thats what wants me to go as far as needed.
Well i asked the solicitor to review the case in full, all evidence and then provide me with her professional opinion whether we should go.
shes going to ring me tomorrow morning........
