he was coming from the opoisite direction, and from his prespective he was turning right, which in my prespective he was turning left hope that makes sense

You say that you'd only very slightly pulled onto the roundabout ? If there was plenty of room for him to go past, and you weren't blocking the roundabout in any way, I don't see how they can say it was his fault if he went into you (i.e. you weren't really on the roundabout at all).

this is a mini roundabout, totally agreee with you and this is what im saying, but insurance are saying even though i was only a bit on the roundabout, i am still n the rounabout, then being my fault :cursing:

Did you manage to get any photos (e.g. on your phone) ? It's very handy if you had a photo, e.g. showing where the two cars made contact and if you could show he was way off his normal line. Otherwise you're probably just relying on some witness statements.

this is the thing i missed out on, we both stopped, and we were right next to a police station, so officers came out straight away and got the cars moved into a nearby car park no chance to take any photos him or me, only got photos after of his car and mine.

will post pics of his when my bro sends them to me, his car the damage you can tell, cause his damage is just the front of the car nothing to the side, so if he was turning it would be to the side of the car

Did you get the ID numbers of any of those police officers ? Or you may be able to find out who was on duty at the time and so who it was ? Surely one of them will be able to back up your story of you not really being on the roundabout ?
