Sorry if I'm being really dumb, but I don't get it. She has signed a contract to have windows fitted and pay x amount on completion. On completion, she either needs to pay up, or give a reason as to why she is not paying.
If she doesn't pay and you take her to court, surely a judge has to rule in your favour as you have done nothing wrong, and she has no actual reason for saying she is unhappy?
Obviously if the truth is that she has no money, then that will be a fruitless path, but it's really sad that your business is getting screwed over and there's no one to back you up - going back to why I started this thread, in the US it's completely the other way round, and that's the way it should be.
she says she doesnt like the handles or the welds on the corners of the windows! which ive offered to change both but she has refused!
she also said she wants 14 days to check the job over etc untill she pays
im currently looking in to taking her to court! but like you said if she has no money im gona end up gettting stung for court costs!
it should be like the us over here!!! bring in capital punishment for non payers lol!
You can use the small claims court for claims up to £5,000. Costs should be minimal, and should be awarded against her if you win anyway.
last time I looked it was 10% of the value of the claim - so £250 to involve the small claim people.
