Lets say you resigned from your job on the 6th January. Your employer pay you for the current month (not month behind)
but end of Feb you still got paid for the whole month instead of the 2 hours you were in work for.
You been paid the extra? what would you do? own up? or not say a word, and are there any legal positions on this. Google didnt get much hits

i think if hes contracred by full time job they have to pay an extra month so you at least got some money until you can find another job

If they do notice they have paid you to much they cannot take it back out of your account , all they can do is ask you to pay it back, then you could say I'll pay back £5 a week. It is not your responsibility to make sure they have paid you the right ammount of £££££££££££

It not your "friends" responsibility to let them know. He may not have "noticed" it happened. However if they ask for it back you have to give it.
I got paid for 3 extra months after i left a job once. Told them the 1st month (what can I say I'm honest) but they kept paying me so I just left it.
One trick if they ask for the money back is to say you have spent it and you'll give them £10 a month back untill its paid off. They might well just leave it.

From a legal point of view, if your friend is taking/accepting money that is not his to take that is theft - even if it is paid directly into his account etc... If you are given to much change from a shop and keep it that is also theft.
If they want it back you would have to by law pay it back - only a court could instruct them to accept a weekly payment, then your friend would have the legal costs added to the claim.
However if it was me I would keep it in a seperate account for a couple of months so it is there if they notice. After 3 months or so pocket it, and smile.
