Read something quite alarming on the merc forums yesterday that I thought was worth mentioning here if you haven't heard it before. Basically a guy on there has been prosecuted basically for having his hand near his face!
He was pulled over saying it looked like he was on the phone, said he wasn't, phone was in centre console, no calls or texts in the history but he's still been sent a NIP. Now it's a fine and 3 points or take it to court.
And looking on the net it seems that this has become quite common, there are threads on pistonheads and many other places of very similar cases, and apparently the "using a phone while driving" penalty can have quite a substantial effect on your insurance premium.
I don't know what can be done really other than a suggestion over there which was to keep the phone in the boot so when they pull you over get out and take it out!
At least keep the phones out of reach though, either in your pocket or in the glovebox, don't put it in the centre console as it's too easy for it to look like you just dropped it in. Worth having a car kit of sorts too to use that as an argument as well.
This story has me completely shocked, it's like we're in the third world......clearly not far off the police accepting bribes to let you off......cared:

Thats exactly what bluetooth hands free is for!! unless you have a phone that doesn't for some reason have bluetooth.

the only problem with that could be thats lets say the phone wasnt activated during the time-frame they pulled you....job done?

if they could say "you left coventry at 14:00, we pulled you at 14:20 for beleiving you were on the phone but logs say you werent, however the logs state you were using the phone at 14:10"
could be tricky to disprove
Ive heard of stories of people getting done for sending a text message 10 minutes prior to an accident and this deeming then to be dangerous driving............
Well with a car kit you'd be handsfree so you'd just say I made a call but wasn't using the handset?
